Definition
Term
The party that institutes criminal proceedings against an accused on behalf of the state.
Prosecution
A person charged with a criminal offence but who has not been found guilty or pleaded guilty.
Accused
An act or omission that is against an existing law, harmful to both an individual and to society, and punishable by law.
Crime
An amount of money that one party is ordered to pay to another party for loss or harm suffered. It is the most common remedy in a civil claim.
Damages
A penalty imposed by a court on a person guilty of a criminal offence.
Sanction
The degree or extent to which a case must be proved in court.

Burden of Proof
A party who is alleged to have breached a civil law and who is being sued by a plaintiff.
Defendant
A person who has been found guilty of a criminal offence by a court.
Offender
The party who makes a legal claim against another party in court (in civil disputes).
Plaintiff
Any order made by a court (or tribunal) designed to address a civil wrong or a breach.
Remedy
A Latin term that literally means 'wrong'; a wrong that interferes with a person's legally protected interests
