What about tinamous?

Good question. Tinamous are indeed a part of the infraclass Palaeognathae, however the term 'ratite' is polyphyletic and only includes the members of that group that lack a keel bone and therefore are unable to fly. Tinamous are the one exception and do possess a limited flight capability, and therefore are excluded from the ratite group.
